Acceptance and eligibility
These Terms and Conditions (“Terms”) are an agreement between you and AirDuct ProCare (“AirDuct ProCare,” “we,” “us,” or “our”). They apply when you access airductprocare.com (the “Website”), submit an inquiry or appointment request, approve an estimate, or purchase or receive services from us.
By taking any of those actions, you acknowledge that you have read and agree to these Terms. You must be at least 18 years old and legally capable of entering an agreement. If you act for a property owner, business, landlord, tenant, association, or another person, you represent that you are authorized to do so.
A written estimate, work order, invoice, booking confirmation, or service-specific agreement may contain additional terms. If a directly conflicting term appears in a document signed or expressly approved by both parties, that service-specific term controls for that service.
Website information
Website content is provided for general informational and scheduling purposes. Descriptions, examples, estimated benefits, availability, promotions, and other information may change. Website content is not a binding offer, professional engineering report, medical advice, fire-safety certification, or guarantee that a particular service is appropriate for a property.
We make reasonable efforts to keep information accurate, but errors may occur. A confirmed estimate or work order—not general Website content—defines the authorized scope and price for a particular service.
Appointment requests and confirmation
Submitting an online form requests an appointment; it does not guarantee a specific date, time, technician, duration, price, or service availability. An appointment becomes confirmed only after AirDuct ProCare accepts it through email, telephone, text message, or another direct confirmation.
Arrival times and service durations are estimates. Traffic, weather, earlier appointments, equipment issues, property conditions, emergencies, and other circumstances may affect timing. We will make reasonable efforts to communicate material delays or changes using the contact information you provide.
Estimates, prices, and payment
Prices depend on the requested service and the information available when the estimate is prepared. Relevant factors may include property size, number of systems or vents, equipment configuration, accessibility, contamination or buildup, repair needs, safety conditions, and the agreed scope of work.
- No upfront payment: We do not require upfront payment for standard services.
- No hidden charges: We will explain material price changes or additional recommended work and request authorization before proceeding.
- Estimate accuracy: An estimate based on customer-provided information may change if on-site conditions materially differ from what was described or reasonably visible.
- Payment timing: Unless otherwise stated in an approved work order or invoice, payment is due when the authorized service is completed.
- Taxes and required charges: Applicable taxes or government-required charges may be added where legally required.
You agree to pay the amount approved for completed services. If you dispute a charge, contact us promptly with the appointment details and a description of the concern so we can review it.
Changes to the service scope
During inspection or service, previously hidden or unexpected conditions may become visible. Examples include inaccessible ductwork, damaged components, excessive debris, pest activity, moisture, suspected microbial growth, structural defects, code or safety concerns, disconnected vents, heavy creosote, or equipment that cannot be safely operated.
If those conditions affect the work, we may recommend a revised scope, additional service, specialist evaluation, or rescheduling. We will not perform material additional billable work without authorization, except for a limited action reasonably necessary to prevent immediate injury or property damage where obtaining authorization is not practicable.
Cancellations and rescheduling
If you need to cancel or reschedule, please contact us as early as reasonably possible. We do not impose a cancellation or missed-appointment fee unless that fee was clearly disclosed to you and accepted before the appointment was confirmed, and the fee is permitted by applicable law.
We may reschedule, suspend, or cancel an appointment because of unsafe conditions, severe weather, inaccessible work areas, inaccurate booking information, equipment problems, technician availability, suspected illegal activity, abusive conduct, or circumstances beyond reasonable control. If we cannot complete the authorized work, payment remains due only for authorized services or materials properly provided, subject to applicable law and any written agreement.
Nothing in these Terms limits any non-waivable cancellation, rescission, or refund right available under federal, state, or local law.
Customer responsibilities
You agree to:
- Provide accurate contact, property, equipment, service, and access information;
- Be present or arrange for an authorized adult to provide access and approve decisions;
- Confirm that you own the property or have authority to authorize the work;
- Disclose known hazards, fragile surfaces, pets, pests, asbestos or lead concerns, mold, water damage, electrical problems, structural issues, alarm systems, access restrictions, and other relevant conditions;
- Clear reasonable access to vents, returns, appliances, HVAC equipment, chimneys, fireplaces, dryer connections, panels, attics, crawl spaces, and other agreed work areas;
- Secure children and pets away from equipment and active work areas;
- Protect or remove valuables, fragile items, artwork, electronics, and personal property near the work area; and
- Follow reasonable safety and post-service instructions.
You are responsible for obtaining approvals required from an owner, landlord, association, building manager, or other controlling party unless AirDuct ProCare expressly agrees in writing to obtain them.
Property access and safety
Service depends on safe, lawful, and reasonably unobstructed access. We may decline to enter or continue working in an area that presents a suspected health, fire, electrical, structural, environmental, animal, harassment, weapons, or other safety risk. We may also decline work that would require activity outside the approved scope, applicable licensing, manufacturer instructions, or safe operating practices.
If furniture, appliances, panels, vents, or building materials must be moved, opened, removed, cut, drilled, or modified, we will seek authorization when the action is outside the reasonably expected service scope. Restoration, painting, carpentry, patching, code upgrades, and access construction are excluded unless specifically included in writing.
Service-specific limitations
Results depend on the condition, design, age, maintenance history, accessibility, and operation of the property and its systems. Unless a written work order expressly states otherwise, the following limitations apply:
Air ducts and indoor air
Cleaning may remove accessible dust and debris but cannot guarantee complete removal from inaccessible areas or guarantee health outcomes, odor elimination, energy savings, or allergen-free air.
Dryer vents
Cleaning can improve airflow and reduce lint buildup, but it cannot eliminate every fire risk or correct damaged, improperly designed, concealed, or disconnected venting unless repair is included.
Chimneys and fireplaces
Standard cleaning and visual inspection do not replace a specialized structural evaluation, camera inspection, code inspection, or higher-level chimney inspection unless specifically included in writing.
HVAC work
Diagnosis may reveal additional faults after a repair begins or equipment is tested. Performance also depends on system design, connected components, utilities, controls, and property conditions.
Mold and moisture
A visual mold or moisture inspection is not laboratory testing, medical advice, engineering analysis, or remediation unless those services are expressly included. Recurrence may occur if the moisture source remains.
Commercial properties
Work may depend on building access, shutdown approval, site rules, security clearance, permits, equipment scheduling, and coordination with property representatives or other trades.
We may recommend evaluation or work by another appropriately qualified professional when a condition falls outside the approved scope or our reasonable ability to address it.
Photos and service documentation
We may take photographs or video of equipment, vents, ducts, chimneys, fireplaces, dryer connections, HVAC components, damage, hazards, and before-and-after conditions for inspection, documentation, quality control, estimates, insurance, dispute resolution, and service records.
We will not intentionally use identifiable images of you or private areas of your property for public marketing without permission. You may ask the technician about documentation before work begins, although certain records may be reasonably necessary to document conditions and completed work.
Service quality, concerns, and warranties
AirDuct ProCare will perform authorized services in a professional manner consistent with the approved scope. If you believe there is a problem with completed work, contact us promptly and provide reasonable details, photographs if available, and access for inspection. We should be given a reasonable opportunity to evaluate and, where appropriate, address a verified service-related concern before another provider changes the relevant work.
Any specific parts, labor, workmanship, manufacturer, or satisfaction warranty applies only if it appears in the applicable written estimate, work order, invoice, or warranty document. Manufacturer warranties are subject to the manufacturer’s terms. We do not warrant pre-existing components, customer-supplied parts, inaccessible conditions, normal wear, misuse, lack of maintenance, third-party work, or conditions outside the authorized scope.
Refunds, credits, re-performance, or other remedies are evaluated based on the circumstances, the written service documents, and applicable law. Nothing in these Terms removes a warranty or remedy that cannot legally be excluded.
Electronic communications
When you provide contact information, you authorize us to communicate about inquiries, estimates, scheduling, arrival updates, service, invoices, safety, and customer support through email, telephone, or text message as appropriate. Message and data rates may apply.
Marketing messages will be sent only as permitted by law and consistent with your choices. Consent to receive marketing text messages is not a condition of purchasing services. You may opt out of promotional email through the message instructions and opt out of text messages by replying STOP. Operational communications about an active request or appointment may still be sent through other permitted channels.
Privacy
Our Privacy Policy explains how we collect, use, disclose, and protect personal information and describes available privacy choices. The Privacy Policy is incorporated into these Terms by reference.
Website content and acceptable use
The Website, brand, logo, text, photographs, graphics, layouts, videos, and other content are owned by AirDuct ProCare or used with permission and are protected by applicable intellectual-property laws. You may view or print reasonable portions for personal, noncommercial use. No other copying, scraping, republishing, sale, modification, or distribution is permitted without prior written authorization.
You may not:
- Use the Website for unlawful, fraudulent, abusive, threatening, or misleading activity;
- Interfere with Website operation, security, access controls, or other users;
- Upload malicious code or attempt unauthorized access to data or systems;
- Submit false appointments, impersonate another person, or provide information you are not authorized to provide; or
- Use automated tools to extract content or data in a manner that creates unreasonable load or violates applicable law.
If you submit a review, testimonial, comment, photograph, or other content for public use, you represent that you have the right to provide it. Any permission to use customer content for marketing will be governed by the authorization provided at the time.
Disclaimers
To the fullest extent permitted by law, the Website is provided on an “as available” basis. We do not guarantee uninterrupted access, error-free content, or that Website information will meet every user’s needs.
Service recommendations are based on the information and conditions reasonably available at the time. Unless expressly included in writing, our services are not a substitute for medical advice, environmental laboratory testing, structural engineering, code enforcement, fire-department inspection, insurance evaluation, or services requiring a different specialist.
References to cleaner air, improved airflow, efficiency, energy savings, odor reduction, safety, or similar benefits describe potential outcomes and are not guarantees. Actual results vary by system, property, use, maintenance, and conditions outside our control.
Limitation of liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including rights available under applicable consumer-protection law.
To the fullest extent permitted by law, AirDuct ProCare is not responsible for indirect, incidental, special, exemplary, punitive, or consequential damages, or for loss caused by pre-existing damage, concealed conditions, inaccurate information, customer failure to follow instructions, unauthorized third-party work, normal wear, equipment failure outside the approved scope, or events beyond our reasonable control.
To the fullest extent permitted by law, AirDuct ProCare’s aggregate liability arising from a specific paid service will not exceed the amount paid to AirDuct ProCare for that service. This limitation does not apply where prohibited by law or to liability that cannot legally be limited.
Applicable law and dispute resolution
These Terms are governed by applicable federal law and the non-waivable laws that apply to the location where the service is performed, without depriving a consumer of protections that cannot be waived by contract.
Before starting formal proceedings, you and AirDuct ProCare agree to make a reasonable good-faith effort to resolve the concern directly. Send a written description of the issue, the relevant service date, and the requested resolution using the contact details below. This informal process does not prevent either party from seeking urgent relief or using a government, regulatory, small-claims, warranty, insurance, or other process available by law.
These Terms do not require arbitration and do not waive any right to a jury trial unless you separately agree to such terms in a legally enforceable written agreement.
General terms and updates
- Changes: We may update these Terms prospectively. The revised version will be posted here with a new effective date. Changes do not retroactively alter an already approved service agreement unless the parties agree or the law requires it.
- Severability: If a provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue to apply.
- No waiver: Failure to enforce a provision does not waive the right to enforce it later.
- Assignment: You may not transfer an appointment or agreement without our consent. We may assign rights and obligations in connection with a lawful business reorganization or transfer, subject to applicable law.
- Entire agreement: These Terms, the Privacy Policy, and the applicable confirmed estimate, work order, invoice, or written service agreement form the agreement concerning the Website and relevant service.
- Force majeure: Neither party is responsible for delay or nonperformance caused by events beyond reasonable control, except that this does not excuse payment for authorized services already properly provided.
